Sample interview questions
I would begin with the product roadmap, competitive landscape, business priorities, and the defensibility of each invention. I would create a consistent invention-review process with Product and Engineering, evaluate patentability and freedom-to-operate risks, and prioritize filings that protect differentiated technology, strategic markets, and potential licensing value. I would also use regular portfolio reviews to retire low-value assets and manage outside-counsel spend efficiently.
I would establish an intake and approval process that identifies each component, license, intended use, modification history, and distribution model. I would assess obligations such as attribution, source-code disclosure, notice requirements, and copyleft exposure, then provide practical mitigation options such as replacement components, architectural separation, or compliance documentation. I would partner with Engineering to make compliance repeatable through tooling, training, and release controls.
I would quickly assess the mark, relevant goods and services, jurisdictions, likelihood of confusion, prior-use evidence, and launch timeline. I would present business stakeholders with a clear risk assessment and options, which may include adopting an alternative mark, narrowing usage, seeking coexistence, or proceeding with an informed risk decision. My goal would be to preserve launch momentum while protecting the company from avoidable enforcement and rebranding costs.
I review chain of title, employee and contractor invention assignments, registered and unregistered IP assets, inbound and outbound licenses, open-source compliance, encumbrances, disputes, data rights, and restrictions on assignment or change of control. I also assess whether the target actually owns the technology that drives its valuation and identify remediation steps, representations, indemnities, and closing conditions where needed. The output should translate legal findings into concrete business risk and integration priorities.
I use concise, decision-oriented communication that explains the issue, business impact, likelihood, available options, and my recommended path. I avoid unnecessary legal jargon and tailor the depth of analysis to the audience, whether it is Engineering, Marketing, executive leadership, or Finance. I also document decisions and follow-up actions so stakeholders understand both the rationale and their responsibilities.
